These Terms of Service ("Terms") govern your access to and use of the Obsurfable website, platform, and related services (collectively, the "Services") operated by Obsurfable ("we," "us," or "our"). By accessing or using the Services, you agree to these Terms.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions and payment

Paid plans are billed according to the pricing and billing terms presented at checkout. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Fees are non-refundable except where required by law or explicitly stated otherwise.

We may change pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.

Acceptable use

You agree not to:

• Use the Services for unlawful, harmful, or fraudulent purposes
• Attempt to gain unauthorized access to our systems or other accounts
• Interfere with or disrupt the integrity or performance of the Services
• Scrape, reverse engineer, or copy the Services except as permitted by law
• Upload content that infringes intellectual property or privacy rights
• Use the Services to send spam or unsolicited communications

Your content

You retain ownership of content you submit to the Services. You grant us a limited license to use, store, and process that content solely to provide and improve the Services. You represent that you have the rights necessary to submit such content.

Intellectual property

The Services, including software, design, text, graphics, and trademarks, are owned by Obsurfable or its licensors and protected by intellectual property laws. These Terms do not grant you any rights to our branding or proprietary materials except as needed to use the Services.

Third-party services

The Services may integrate with or link to third-party tools, including AI providers and analytics services. We are not responsible for third-party services, and your use of them may be subject to separate terms.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that AI visibility monitoring will produce specific business outcomes, rankings, mentions, or traffic. AI system outputs are outside our control and may change without notice.

Limitation of liability

To the fullest extent permitted by law, Obsurfable and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim related to the Services is limited to the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Obsurfable from claims, damages, and expenses arising from your use of the Services, your content, or your violation of these Terms.

Termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or if we discontinue the Services. Provisions that by their nature should survive termination will remain in effect.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes will be resolved in the courts located in Delaware, unless otherwise required by applicable law.

Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may be communicated by email or through the Services. Continued use after changes constitutes acceptance.
